Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AutomationFire platform, including the website at automationfire.com, the customer dashboard at app.automationfire.com, our mobile applications, our public APIs, and any related services (collectively, the “Service”), provided by Blue Taurus Marketing LLC (“AutomationFire,” “we,” “us,” or “our”).

By creating an account, redeeming a code, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity, in which case “you” refers to that entity. If you do not agree to these Terms, do not use the Service.

1. Eligibility and account

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@automationfire.com if you suspect unauthorized access.

You are responsible for ensuring the accuracy of business information you provide and for keeping it current.

2. Subscriptions and billing

The Service is offered on subscription tiers (LTD, SMS, Voice Starter, Voice Growth, Voice Pro) and one-time add-ons (BYON, custom integrations). Pricing is listed at automationfire.com/pricing. Subscriptions renew automatically until cancelled.

Payments are processed by a PCI-compliant third-party payment processor. By providing a payment method you authorize us to charge that method for the applicable subscription fees, taxes, setup fees, and metered overages (such as voice minutes or SMS sent above your tier’s included allowance). All fees are exclusive of taxes unless stated otherwise.

You may upgrade, downgrade, or cancel a subscription from the billing dashboard. Cancellation stops future renewals; service continues through the end of the current billing period. We do not refund partial periods except where required by law.

AppSumo lifetime deal codes are non-transferable and may be redeemed only once per account. They grant access to the LTD tier’s email-tier features. SMS and voice are available as add-on subscriptions on top of the LTD account at standard pricing.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send unsolicited bulk messages (spam) over SMS, voice, or email through the Service
  • Place outbound calls in violation of the Telephone Consumer Protection Act (TCPA), applicable state mini-TCPA statutes, the CAN-SPAM Act, or any international equivalents
  • Generate or use the AI components of the Service to produce harmful, defamatory, deceptive, or fraudulent content
  • Impersonate another person or business, or misrepresent your affiliation with a business
  • Attempt to access systems, accounts, or data you are not authorized to access
  • Reverse engineer, decompile, or attempt to extract the source code of the Service except to the extent expressly permitted by applicable law
  • Resell or sublicense the Service without an active reseller / partner agreement
  • Use the Service to circumvent Google’s API Services User Data Policy or any other third-party platform’s terms
  • Interfere with or disrupt the integrity, performance, or security of the Service

We may suspend or terminate accounts that violate these rules, that fail payment for more than thirty (30) days, or that we reasonably believe pose a security or compliance risk.

4. Voice, SMS, and call recording

When you enable the Voice Engine, calls placed to your business number may be answered, recorded, transcribed, and processed by AI on your behalf. You are solely responsible for ensuring that any disclosures required by your jurisdiction (one-party-consent, two-party-consent, or other call-recording rules) are communicated to callers, and you authorize AutomationFire to include such disclosures in the agent’s greeting if you configure them.

When you enable the SMS feature, you agree to comply with the 10DLC carrier registration requirements, the TCPA, and any applicable carrier policies. You represent that recipients of SMS messages sent through the Service have provided prior express consent where required.

5. Customer data and your responsibilities

You retain ownership of all data you provide to the Service and all data generated by your customers’ interactions with you through the Service (“Customer Data”). You grant AutomationFire a worldwide, non-exclusive, royalty-free license to host, process, store, and transmit Customer Data solely as needed to operate and improve the Service for you.

You are responsible for the legal basis for processing Customer Data, for providing required disclosures and obtaining required consents from your customers, and for honoring data-subject requests received from your customers. We will assist you with such requests in line with the Privacy Policy.

6. Intellectual property

AutomationFire, the AutomationFire name and logo, and the underlying software, templates, designs, and content are the property of Blue Taurus Marketing LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.

Generated websites, blog posts, social media captions, review responses, and other outputs created for you through the Service are owned by you. You are responsible for reviewing AI-generated outputs before publication.

7. Third-party services

The Service integrates with third-party platforms you connect (such as Google Business Profile, Google Search Console, Google Calendar, Microsoft 365, and your CRM or field-service tools), and relies on subprocessors for hosting, telephony, AI, payments, email delivery, analytics, and review aggregation. Use of these integrations is subject to the respective third party’s terms and privacy policies. The current named subprocessor list is available on request from privacy@automationfire.com. AutomationFire is not responsible for the availability, accuracy, or content of third-party services.

8. Service availability and changes

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time, with or without notice. We will provide reasonable advance notice of material changes that negatively affect paid subscribers.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. AutomationFire does not warrant that the Service will be error-free, that defects will be corrected, or that the Service will produce specific business outcomes such as ranking improvements or revenue.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AUTOMATIONFIRE, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF AUTOMATIONFIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid AutomationFire for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless AutomationFire and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) Customer Data you submit or process through the Service; or (d) your use of the Voice Engine or SMS feature in violation of TCPA, CAN-SPAM, or analogous laws.

12. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate your account for violation of these Terms, non-payment, abuse, or other cause. Upon termination, your right to access the Service ends. We will retain or delete data in accordance with the Privacy Policy.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws principles. The exclusive jurisdiction and venue for any dispute arising out of these Terms is the state and federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.

14. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice through the Service or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
